Mokelta Professional and Association Terms

These Terms govern access by veterinarians, other professionals, and authorised Association representatives to the Mokelta Professional Portal (vet.mokelta.pt). They are distinct from the Terms of Service that apply to pet owners.
By creating a professional or Association profile in the Portal, you declare that you have authority to bind the entity you represent and accept these Terms. Your acceptance is recorded with its date, version and language.

2. How you obtain access
- Access to an animal is granted exclusively by its owner, through an invitation in the Mokelta app. There is no other way to obtain access.
- Access is per animal, not per client: an invitation gives you access only to the animal named in that invitation.
- The owner may revoke access at any time, without notice and without giving a reason. Revocation immediately blocks the animal's record and the issue of new document links. Every download checks current authorisation again and uses a temporary link, without a persistent download token, that is valid for up to 60 seconds. A link already issued may remain usable only until that short period ends. If you saved a copy of the file, you must delete it when access ends.
- The owner can see the date you last opened the record.
3. Professional credentials
- You undertake to state truthfully your name, clinic, and professional licence number.
- The details are self-declared. Mokelta review may control access, but is not an automatic OMV lookup, endorsement, or professional guarantee.
- If you cease to be entitled to practise, you must stop using the Portal and delete your profile.
4. Read-only access and use of data
- You may view only the record of an animal for which the owner has given you an active invitation.
- In this release the Portal is read-only: you cannot create, change, or delete clinical entries, care logs, or documents.
- You must not use the data for marketing, build your own database, disclose it to third parties, or use it outside the animal's care.
- You must delete downloaded copies when access ends unless a specific legal duty requires otherwise.
5. Mokelta is not your official clinical record
The Portal is a read-only sharing tool for the animal's owner and does not replace the clinical record the law requires you to keep. The owner may revoke access or delete the account; keep your own clinical record independently.
6. Data protection
- When viewing information in the Portal you act in your own name and within your professional duties, including confidentiality and data protection.
- Mokelta processes the data entrusted to it as a platform. Information about that processing is in the Privacy Policy.
- Your own data: your name, clinic, licence number and phone are processed by us, and your name is visible to the owners of the animals you attend. What we collect and why is described in section 2.2 of the Privacy Policy.
- You must treat the data you access with the confidentiality required by professional secrecy.
- If you receive a request from an owner concerning their data (access, rectification, erasure), you should answer them directly and, where necessary, contact us.
7. Account security
- The account is personal. Do not share it with colleagues or staff — each professional must have their own.
- Do not use the Portal on shared computers without signing out.
- Report any unauthorised access to us immediately.
7.1 Associations and the public adoption catalogue
This section applies only when the Association feature and public catalogue are activated in an authorised release. V1 does not publish photographs or contact details, collect adoption enquiries, or display clinical information or documents.
- The Association may publish only animals it legitimately cares for and for which it has authority to make the information available.
- The person activating publication declares that they are authorised to act for the Association and that the Association holds the necessary rights in the supplied content.
- The Association must keep each profile accurate and current, use only truthful statuses, and immediately update or remove it when the animal is reserved, adopted, unavailable, or no longer under its responsibility.
- Owner or adopter names or contact details, UIDs, microchip or SIAC numbers, exact addresses, coordinates, clinical information, vaccinations, medication, documents, billing information, free links, sale or breeding advertisements, and text identifying people are prohibited.
- Public information is a minimised and pseudonymised projection. Internal Association, animal, member, and owner identifiers must not be exposed.
- The Association must cooperate with notices, correct information, and provide evidence of its authority or content rights when requested.
- Mokelta may reject, restrict, or remove a profile to protect animals or people, comply with law, respond to a notice, correct information, prevent abuse, or when the Association no longer meets the applicable conditions. Where appropriate and legally permitted, it will communicate the decision and how it may be challenged.
- Mokelta displays supplied information but does not recommend adopters, decide adoptions, become a party to agreements, transfer ownership, or make SIAC registrations. The Association remains responsible for its adoption process and applicable legal duties.
The reporting channel, report-record retention, moderation, automatic removal, and end-to-end tests must be configured and approved before publication. Acceptance of these Terms is not consent for processing that requires a separate legal basis.
8. No availability guarantee
The Portal is provided free of charge and as is, and may be unavailable, changed or discontinued. You must not depend on it for urgent acts, nor as your only source of clinical information.
9. Termination
- You may delete your professional profile at any time, in the Portal's Settings. Doing so removes your access to every record.
- You may also delete your whole account there, which removes your profile, your account and every access owners have granted you.
- We may suspend or terminate your access in the event of a breach of these Terms, suspected misuse of data, or an indication that you are not entitled to practise.
10. Changes to these Terms
If we materially change these Terms, the Portal asks you to accept them again before continuing. If you do not accept, access remains blocked; Mokelta does not create or change clinical records on your behalf.
11. Governing law
Portuguese law applies. For data-protection matters the supervisory authority is the CNPD.
